浅析我国征地制度中"公共利益"界定与征地范围划分问题

在我国,土地征用权的法律规定主要来自《宪法》、《土地管理法》和《城市房地产管理法》。我国宪法,虽然赋予国家征用土地的权利,却没有为这种权利的行使划定明确的范围、界限、方式和程序;现行法律中关于土地征用权的规定互相矛盾,从而导致土地征用权的滥用,同时还存在对农民的补偿和安置不到位等问题。因此迫切需要完善土地征用制度,明确界定“公共利益”的范围,文章就此问题进行了初探,并提出了完善征地制度的建议。

Recovering Hicksian Consumer Surplus within a Collective Model: Hausman's Method for the Household

The purpose of this paper is to describe the implications of the collective model of household behavior for the methods used to estimate the economic value of non-marketed environmental resources. After demonstrating how the separability restrictions inherent in the collective model allow individual preference and household income allocation choices to be distinguished, the paper demonstrates how the framework can be used to recover Hicksian consumer surplus. An algebraic example is used to illustrate how the framework can be used in valuing environmental resources.     

Problems of private industrial economic development and its countermeasures for Zigong City,Sichuan Province,China

The differences of regional economic development between underdeveloped areas and developed areas are mainly embodied by different levels of private economic development. Since 20-year reform and opening-up to the outside world, the private industry of Zigong has developed gradually, become more and more economically competitive, and played a more and more important role in the economic structure of Zigong. This paper analyzes the problems of private economy and its countermeasures based on the research on its status quo.     

Labour unions and leverage: evidence from firm-level union data

ABSTRACT

Using firm-level labour union data from Japan, this paper investigates the effect of labour unions on firm leverage. We find that as union coverage increases, both the level of and extent of change in leverage decreases. These relations remain robust when a firm falls into deficit. We also find that firms with higher union coverage have a higher interest coverage ratio. In addition, we find that firms with higher union coverage are less likely to choose issuing debt compared to issuing equity when they face financial distress. Our results imply that significant employee influence enhanced by labour unions increases fixed costs, crowds out the firm’s debt capacity and consequently reduces the firm’s leverage.     

世界各国社会保障制度改革及其对我国的启示

我国目前正处于经济转型时期,社会保障制度的改革也正处于关键时刻,国外如美国、英国、新加坡等社会保障制度改革的经验和教训,对我国社会保障制度的改革起到很好的借鉴作用。我国社会保障模式,应该是分层次的而不是统一的社会保障模式;只有建立公平的社会保障制度,才能确保制度的效率。     

知识产权侵权归责原则探析——谈无过错责任原则的不适用

知识产权侵权损害赔偿采用何种归责原则,事关知识产权权利人的权益及普遍公众的公共利益.无过错责任原则在知识产权侵权损害赔偿领域的适用打破了知识产权权利人和公共利益的平衡,影响了知识产权制度平衡机制的正常运转,歪曲了知识产权激励机制的本意,束缚了一般民事主体创造知识产品的热情.无过错责任原则在知识产权领域的适用有其天然的弊端和不足,而TRIPS协议第45条也并未将该原则作为一般原则来对待,即便按照民法学方法分析,知识产权侵权损害赔偿也不应适用无过错责任原则.
